My very, very quick reaction (within about two minutes of the decision) to Thursday’s Supreme Court decision on Obamacare was short and not at all sweet. Read it here. You can certainly read plenty of other good analysis that explains the legal justification for my visceral reaction. When I have time, I’ll take his decision apart, point by point, just as I did his decision a few years ago treating the “individual mandate” as a constitutionally permissible tax.
Suffice it to say for now that John Roberts has gone down Alice’s rabbit hole and joined its denizens in trying to make words mean whatever suits him at the time, no matter what a dictionary or common practice says.
I repeat: He is a thoroughgoing disgrace.
